Advokasi dalam Hukum Islam: Pendampingan, Pembelaan, dan Perlindungan Hak dalam Perspektif Syariah dan Fiqh

Advocacy in Islamic law is understood as an effort to provide assistance, defense, and protection of rights (ḥaqq) through the instruments of fiqh and uṣūl al-fiqh, oriented toward the objectives of Islamic law (maqāṣid al-sharīʿah), and realized through institutional channels such as legal aid (prodeo), judicial decisions, fatwas, legislative reform, and community-based Alternative Dispute Resolution (ADR) mechanisms. This study synthesizes existing literature to examine how advocacy operates within the normative framework of Islamic law across various issues, including domestic violence, disability, child labor, unregistered marriages, sexual violence against children, human trafficking, gender advocacy, minority rights, and economic rights protection. Using a doctrinal and socio-legal approach through literature review, this article demonstrates that the maqāṣid framework provides a normative basis for centering advocacy on the protection of life, dignity, intellect, lineage, religion, and property. Nevertheless, the literature also warns that advocacy requires methodological rigor and careful attention to the consequences of codification, interpretive conservatism, and the boundaries between fixed provisions (thawābit) and dynamic areas of ijtihad (mutaghayyirāt). Consequently, advocacy in Islamic law is ultimately a scholarly-practical endeavor that demands methodological competence, social sensitivity, and institutional strengthening so that the ideals of justice and rights protection genuinely manifest as accessible legal experiences for all people, especially vulnerable groups.
Advokasi dalam hukum Islam dipahami sebagai upaya pendampingan, pembelaan, dan perlindungan hak (ḥaqq) yang beroperasi melalui perangkat fiqh dan uṣūl al-fiqh, berorientasi pada maqāṣid al-sharīʿah, serta diwujudkan melalui kanal institusional seperti bantuan hukum (prodeo), putusan peradilan, fatwa, reformasi legislasi, dan mekanisme ADR berbasis komunitas. Studi ini mensintesis literatur yang tersedia untuk mengkaji bagaimana advokasi beroperasi dalam kerangka normatif hukum Islam pada berbagai isu, meliputi kekerasan dalam rumah tangga, difabilitas, pekerja anak, perkawinan tidak tercatat, kekerasan seksual terhadap anak, perdagangan orang, advokasi gender, hak minoritas, serta perlindungan hak ekonomi. Dengan menggunakan pendekatan doktrinal dan sosio-legal melalui kajian pustaka, artikel ini menunjukkan bahwa kerangka maqāṣid memberikan basis normatif untuk memusatkan advokasi pada perlindungan jiwa, martabat, akal, keturunan, agama, dan harta. Meski demikian, literatur juga memperingatkan bahwa advokasi memerlukan ketelitian metodologi dan kehati-hatian terhadap konsekuensi kodifikasi, konservatisme interpretasi, serta batas antara ketentuan tetap (thawābit) dan wilayah ijtihad yang dinamis (mutaghayyirāt). Karena itu, advokasi dalam hukum Islam pada akhirnya adalah kerja ilmiah-praktis yang menuntut kecakapan metodologis, sensitivitas sosial, dan penguatan kelembagaan agar cita-cita keadilan dan perlindungan hak benar-benar hadir sebagai pengalaman hukum yang dapat diakses oleh setiap orang, khususnya kelompok rentan.
